LA RESPONSABILIDAD SOCIAL PÚBLICA: CLÁUSULAS SOCIALES Y MERCADOS TUTEADOS

Abstract

[ES] El presente trabajo trata de realizar una breve aproximación a las cláusulas sociales y los mercados tutelados, una materia reciente que gana relevancia con el paso del tiempo y su integración en los procesos de contratación pública. En primer lugar se aborda la cuestión de las cláusulas sociales ofreciendo una idea general de las mismas, estudiando en profundidad las posibilidades de incorporación en las distintas fases de la contratación pública, la normativa que las regula y los beneficios que las mismas reportan. En segundo lugar se analiza una variedad de cláusulas sociales cual es la figura de los mercados tutelados determinando su concepción y estudiando la vinculación con el tercer sector y la normativa estatal y comunitaria que le es aplicable. En última instancia finalizo el trabajo con unas conclusiones en las que expongo una percepción general de lo estudiado.

[EN] This paper tries to carry out a brief approximation to the social clauses and the tutelary markets, a new subject which is becoming relevant with the time and its integration in the public hiring processes. First of all, the social clauses issue is addressed by offering a general idea and studying in deep the incorporation possibilities in the different stages of the public hiring, their regulation and the benefits that they bring. Secondly, a variety of social clauses is analysed as well as it will be analysed and studied the representation of the tutelary markets, their conception and connection with the third sector and the state regulation applicable to it. As a last resort, conclusions are given basing them on in a general understanding of all which has been previously analysed.
