EL DERECHO DE SECESIÓN

Abstract

[ES] El trabajo tendrá como objeto de estudio: el concepto y la aplicación del derecho de secesión. En primer lugar, daremos una definición aproximada de éste y expondremos sus características, para después compararlo con el derecho de autodeterminación; abordando la evolución, el contenido y la regulación de éste. Hasta este punto y en los apartados 2 y 3, nos centraremos principalmente en la regulación internacional de éste, y a partir del punto 4 lo analizaremos a través del derecho constitucional español y su regulación determinada en este asunto. Ya dentro del derecho interno, abordaremos en primer lugar la influencia de la historia y de los derechos históricos en relación a este tema. Después repasaremos las distintas disposiciones constitucionales que tengan que ver, relacionándolas con las distintas teorías sobre la aplicación del derecho de secesión, y argumentando las distintas razones para su aplicación o no dadas por los expertos constitucionalistas y las diferentes corrientes doctrinales

[EN] This Essay focuses in the concept and application of the right of secession. Firstly, we are going to give an approximate definition of this and we are going to expose its features, then we are comparing it with the right to self-determination; evolution, content and its regulation. At the points 2 and 3, we analyze the essay mainly with the international regulation of this, and from point 4 we are working with the Spanish constitutional law and its specific regulation on this matter. First we are alluding to the influence of history and historical rights in relation here. Last we are going to see the different laws and we are relating with various theories for application of the right of secession. Finally we discuss the various reasons for the application from the point of view of constitutional experts and different doctrinal currents
