EL CONFLICTO EN ORIENTE PRÓXIMO Y EL TRÁFICO ILÍCITO DE BIENES CULTURALES

Abstract

[ES] El presente trabajo pretende analizar la historicidad del concepto de bienes culturales y su adopción como tal a lo largo de los textos normativos que se han sucedido en el tiempo. La conceptualización de bienes culturales servirá de base para profundizar en el estudio del tráfico ilícito del patrimonio como una de las fuentes de financiación de los grupos terroristas que asola Oriente Próximo. Igualmente, se procederá a explicar el procedimiento de restitución de los bienes culturales exportados ilícitamente en cuanto a las modificaciones que ha supuesto la nueva entrada en vigor del Reglamento Bruselas I bis.

[EN] The following lines will deal with the historicity of the concept of cultural goods and his adoption by means of the normative texts that have happened in time. The conceptualization of cultural goods will be used as base to penetrate into the study of the illicit traffic of the heritage as one of the financing sources of the terrorist groups which devastate Middle East. Equally, it will proceed to explain the procedure of restitution of the cultural goods that have been exported illicitly and the modifications that the new enforce of the Regulation Brussels I bis has supposed.
