EL PROCESO MONITORIO Y SU REFORMA LA LEY 42/2015

Abstract

[ES] El presente trabajo analiza lo que se conoce como el proceso monitorio y las importantes modificaciones que ha sufrido recientemente. El proceso monitorio se encuentra regulado en la Ley de Enjuiciamiento Civil, 1/2000 (en adelante LEC), concretamente en su Título III y en los artículo 812-818, contiene una serie de regulación procedimental en la que se distinguen las diferentes fases1. El trabajo se estructura en diferentes capítulos. Un primer capítulo en el cual analizaremos una serie de cuestiones preliminares acerca del proceso monitorio, su origen, el desarrollo del procedimiento y su regulación legal. Un segundo capítulo donde se explicara con detenimiento las distintas reformas que ha sufrido este proceso actualmente, en la Ley 42/2015, ya que han sido abundantes. Finalmente, unas conclusiones que entiendo son la aportación más importante a este trabajo pues las elaboro con los conocimientos adquiridos.

[EN] The present work analyses in depth what is know as payment procedure and the significant change that has recently come about. The payment procedure is regulated in the Civil Procedure Act, Law 1/2000, more precisely in the Title III and in the articles 812-818, it has a serie of legal regulation and different stage. The work is organised into different chapters. In the first chapter, I analyse some preliminary issues about the payment procedure, and it´s legal regulation. In the second chapter I explain in depth the numerous reforms that this process has currently undergone in depth. To conclude, some conlusions that I understand are the most important contribution to this work as elaborated in the foreground.
