ANÁLISIS DE LA PROTECCIÓN DE LA MATERNIDAD, ART. 26, LEY 31/1995 LPRL

Abstract

[ES] A lo largo del tiempo, la mujer ha ido incorporándose en el mercado laboral, pero, a la vez quedando desprotegida frente a los riesgos que están presentes en el trabajo que son perjudiciales para la salud durante el embarazo o posteriormente, llegando abandonar el trabajo para no perjudicar su salud o la de sus fututos hijos a causa de no ser posible eliminar los riesgos. Tras varias modificaciones de la Ley de Seguridad Social, se creó la "prestación por riesgo durante el embarazo o durante la lactancia natural", para facilitar el embarazo con su puesto de trabajo y cubrir la pérdida de ingresos.

En este trabajo se analiza la evolución que ha tenido la protección de la mujer embarazada en el ámbito laboral y en qué consiste esta prestación en caso de no poder desempeñar su trabajo. Se enumeran los riesgos posibles que pueden estar presentes y la actuación que la empresa debe tomar para no llegar a tener estos riesgos o disminuirlos para no tener gran incidencia en los trabajadores.

After several amendments to the Social Security Act, the "risk allowance during pregnancy or breastfeeding" was introduced to facilitate pregnancy with a job and cover loss of income.

This paper analyses the evolution of the protection of pregnant women in the workplace and what this benefit means if they are unable to carry out their work. It lists the possible risks that may be present and the actions that the company must take to avoid having these risks or diminish them so as not to have a large impact on workers.
