INSTITUCIONES DE PROTECCIÓN Y APOYO A PERSONAS CON DISCAPACIDAD TRAS LA CONVENCIÓN DE NACIONES UNIDAS: ESPECIAL REFERENCIA AL ARTÍCULO 12

Abstract

[ES] En este trabajo hablaremos de los distintos sistemas de guarda y protección de menores y personas con discapacidad que existen actualmente en nuestro ordenamiento jurídico. Para poder conocer sus diferencias, estudiaremos su funcionamiento, características individuales que debe poseer la persona con discapacidad para poder beneficiarse de la protección de cada una de ellas, causas de disolución, y, como punto clave de reflexión sobre el que se va a desarrollar esta memoria, ventajas e inconvenientes de cada una de ellas para el sujeto pasivo. La Convención sobre los Derechos de las Personas con Discapacidad de las Naciones Unidas ha impuesto unas consideraciones a tener en cuenta a la hora de establecer y poner en práctica los sistemas de guarda para proteger los derechos fundamentales de toda persona, y debatiremos si las que se encuentran publicadas en las leyes españoles las acatan

[EN] In this document we will discuss the different systems of care and protection of children and people with disabilities that currently exist in our legal system. To get to know their differences, we will study their operation, individual characteristics that persons with disabilities must possess in order to benefit from the protection of each one of them, causes of dissolution, and, key point of reflection on which will develop this memory, advantages and disadvantages of each one of them to the taxpayer. The Convention on the rights of persons with disabilities of the UN has imposed a few considerations to keep in mind when establishing and implementing systems of guard to protect the fundamental rights of every person, and discuss if which are published in the Spanish laws abide by them.
