LOS MATRIMONIOS DE CONVENIENCIA POR LA VÍA CANÓNICA

Abstract

[ES] En el presente trabajo abordaremos la problemática de los matrimonios de complacencia o conveniencia utilizados a menudo, para la obtención de la nacionalidad u otras finalidades ajenas al matrimonio.

Se presentan en nuestra sociedad tanto por la vía civil como por la vía canónica, la diferencia entre ambas es que en la vía canónica se presta el consentimiento matrimonial ante el párroco, en lugar de ante el encargado del Registro Civil. Con lo cual, el control ejercido es posterior a la celebración del matrimonio. Procederemos a la explicación del concepto de simulación, tanto parcial como total, que es causa de nulidad matrimonial así como su regulación actual, finalizando con ejemplos concretos. Por último, comentaremos los matrimonios mixtos entre cristianos y musulmanes provocados por la creciente inmigración y aumento de población musulmana en España. Esta situación afecta al derecho matrimonial, haciendo necesario el establecimiento de acuerdos entre el Estado español y la religión islámica.

[EN]The present work will tackle the problem by marriage of convenience used often to get of the nationality or other finds different to marriage. To present in our society in the civil way like to the canonical form, the difference between both is that the canon form give the consent faced with parish priest, instead of responsible for the Civil Registry. Therefore, the control is later to the marriage. Besides, to continue with the explanation to the concept of simulation, partial and total, that is the cause of invalid marriage like his current regulation, finish with particular examples.

Finally, to talk about the mixed matrimony between christian and muslim cause of the increase immigration and consequently the increase of islamic population in Spain. This situation affects both: family law and marriage law, making it a necessity to establish agreements between the Spanish state and Islam.
