LA MEDIACIÓN EN LOS CONFLICTOS DE PERSONAS CON DISCAPACIDAD.

Abstract

[ES]Con este estudio se trata de abordar la figura de la mediación y las posibilidades que ésta ofrece a las personas con discapacidad, como instrumento extrajudicial para la resolución de conflictos, promoviendo y teniendo en cuenta sus necesidades y derechos, con el fin de potenciar su autonomía tanto en la toma de decisiones como en su participación en la sociedad como personas con plenos derechos en igualdad. La mediación tiene su base teórica en la negociación, es un tercero con el perfil de mediador el que va a promover acuerdos entre las partes en conflicto, con un objetivo común, que las partes vean satisfechos sus intereses, motivando una relación futura de diálogo. De aquí la importancia, de que la mediación sea conocida y aplicada por el colectivo de personas con discapacidad y sus familias.

[EN]This study seeks to know the figure of mediation and the possibilities it offers to people with disabilities, as an extrajudicial tool for resolving conflicts, promoting and taking into account their needs and rights, in order to enhance their autonomy both in decision-making and in their participation in society as people with full rights in equality. The mediation has its theoretical basis in the negotiation, it is a third party with the mediator profile that will promote agreements between the parties in conflict, with a common goal, that the parties see their interests satisfied, motivating a future relationship. Hence the importance of mediation being known and applied by people with disabilities and their families.
