LA EJECUCIÓN PROVISIONAL

Abstract

[ES]Con el presente trabajo lo que se pretende es el desarrollo de la ejecución provisional en nuestro sistema jurídico, comenzando con una explicación de la misma con respecto a nuestra Constitución, así como el desarrollo conceptual, comprendido por las características, finalidades, y diferencias con otras instituciones jurídicas con las que podría ser confundida. Asimismo, se tratan en profundidad las sentencias excluidas de la misma, y el procedimiento que sigue tanto para las resoluciones dictadas en primera instancia como en segunda, sin olvidar el tratamiento de las costas judiciales devengadas por estos procedimientos. Y por último, se hace un breve análisis de las principales modificaciones a las que fue sometida esta institución con la implantación de la ley 13/2009, de 3 de noviembre, de reforma de legislación procesal para la implantación de la nueva oficina judicial.

[EN]The aim of this report is to explain the provisional enforcement in our judicial system. Starting with an explanation, with the Constitutional foundations, and after that the development of the deeper meaning, that includes the principal characteristics, the purpose of this institution and the most important differences with other institutions that can cause confusions. This report, also studies the resolution that are not allowed in this institution, and the process that it takes, during the First instance court or lower court and the Second instance court, and not forgetting the who is in charge of the expenses that are generated in this procedure. And finally, there is a brief analysis of the principal changes that were made in this institution with the application of the law 13/2009.
