DICTAMEN JURÍDICO SOBRE NULIDAD DE ESCRITURA DE COMPRAVENTA Y ACCIÓN REIVINDICATORIA

Abstract

[ES] Dictamen jurídico elaborado para determinar si es viable ejercitar acciones judiciales que declaren la nulidad de una escritura de compraventa por no existir consentimiento del cónyuge copropietario, todo ello por haberse llevado a cabo la operación por uno solo de los cónyuges utilizado en la notaría un poder de representación sin facultades para ello. Al estudio de la misma se le añade la posibilidad de acumular una acción reivindicatoria de propiedad de la hija de la demandante para recuperar la posesión de una finca que ha sido ocupada sin título que lo justifique por el adquirente del primer supuesto.

[EN] Legal opinion prepared to determine the viability of taking legal actions to declare the nullity of a deed of sale because there is no consent of the co-owner, all for having used in the notary a power of attorney without powers to carry out this operation. To the study of this action is added the possibility of accumulating an action claiming property of the daughter of the plaintiff to recover the possession of a property for having been occupied without title that justifies it by the purchaser of the first case.
