INSOLVENCIAS PUNIBLES. El "sobrevivir" a una crisis económica

Abstract

[ES] Durante el desarrollo del presente trabajo fin de máster se llevará a cabo el estudio de un supuesto práctico que se enmarca en los delitos del alzamiento de bienes recogido en el artículo 257 del Código Penal. En este dictamen jurídico se plantean una serie de cuestiones jurídicas para resolver mediante la compilación de toda la normativa aplicable y la reiterada jurisprudencia, relativas al derecho a no declarar contra sí mismo, el delito continuado, el efecto de cosa juzgada, la reincidencia, el sobreseimiento de las personas jurídicas en un proceso penal y la condicional de una pena privativa de libertad. Se extraen una conclusiones y para finalizar, se adjuntan aquellos escritos jurídicos que fueron necesarios durante todo el procedimiento judicial, desde la querella criminal y el escrito de acusación hasta el Recurso de Reforma, y subsidiario, de Apelación contra el Auto de Sobreseimiento de las personas jurídicas.

[EN] During the development of the present work end of máster will carry out the study of a practical supposition on the crime of elevation of goods, gathered in the article 257 of the Criminal Code. In this legal opinion there appear a series of juridical questions to resolve by means of the compilation of the whole applicable regulation and the repeated jurisprudence relative to the right not to declare against yes same, the continuous crime, the effect of judged thing, the repetition, the nonsuit of the legal persons in a penal process and the conditional one of a custodial sentence. A conclusiones is extracted and to finish, there are attached those juridical writings that were necessary during the whole judicial procedure, from the criminal complaint and the writing accusation up to the Resource of Reform, and subsidiarily, of Appeal against the Car of Nonsuit of the legal persons.
