LA CUSTODIA COMPARTIDA EN EL SUPUESTO DE MODIFICACIÓN DE MEDIDAS DEFINITIVAS EN UN PROCEDIMIENTO DE DIVORCIO

Abstract

[ES] El presente Trabajo de Fin de Máster ofrece una visión sobre la institución de custodia compartida, destacando en este sentido los pronunciamientos actuales de la jurisprudencia española que generan algunos supuestos, entre ellos los procedimientos en los que se decide la custodia compartida de un menor que se encuentra dentro del periodo de lactancia o de una mascota, que a pesar de que cada vez son mas frecuentes este tipo de casos aún no existe un pronunciamiento por parte del Tribunal Supremo. Finalmente, se realiza un análisis de la regulación existente en España en esta materia frente al derecho francés, italiano y alemán.

[EN] The present Master’s Dissertation offers a vision about the shared custody institution, highlighting in this sense the current pronouncements of the Spanish jurisprudence that generate some assumptions. Among them, it will focus on the procedures in which it is decided the shared custody of a minor who is in the period of breastfeeding or a pet. Despite the fact that such cases are becoming more frequent, there is still no pronouncement by the Supreme Court. Finally, an analysis is made about the existing regulation in Spain in this topic versus the French, Italian and German law.
