Abstract

[ES] En este supuesto en el que tratamos de un menor (Antonio) que, le coge una escopeta a su padre para jugar con su amigo Ramón a pegar tiros a una lata y, en el forcejeo de estos dos para coger dicha escopeta para tirar se acciona el tiro por mero error de Antonio al tener el dedo en el gatillo y disparar en dicho forcejeo sin realmente querer dicho resultado. Abordaremos pues las cuestiones que pueden darse frente a este supuesto como es el delito de tenencia ilícita de armas, analizaremos los supuestos que se dan frente al homicidio imprudente, la relevancia que tiene la víctima frente a dicho delito así como la posible responsabilidad que tienen los padres de Antonio por la comisión de dicho delito. Para fundamentarnos en estas explicaciones se ha utilizado diversa jurisprudencia y textos manuales.
