IGUALDAD Y NO DISCRIMINACIÓN

Abstract

[ES] Este trabajo fin de grado surge como consecuencia de las desigualdades latentes que a día de hoy sufrimos en nuestra sociedad. Me he interesado especialmente en el ámbito laboral, diferenciando el trabajo público del privado y el tratamiento que ambos dan a la igualdad y no discriminación en su seno. En una primera aproximación, se recogen los derechos que amparan la igualdad entre hombres y mujeres y luchan contra la discriminación de todo tipo, diferenciando el marco constitucional de la jurisprudencia tanto del Tribunal Constitucional, como del Tribunal Europeo de Derechos Humanos. Tras conocer los derechos que nos amparan, el grueso del trabajo se centra en la discriminación laboral en España por razón de sexo, en cuyos apartados se habla sobre la normativa aplicable a esta, las medidas que las empresas privadas y el sector público deben aplicar y se trabaja la Ley 3/2007, sobre la igualdad efectiva entre hombres y mujeres y la Ley 39/1999, de conciliación de la vida laboral, familiar y personal. Del mismo modo, se abarca el actual tema del mobbing en las empresas y las barreras que suponen el techo de cristal para las mujeres trabajadoras.

[EN] This final degree project arises as a consequence of the latent inequalities that we suffer today in our society. I have been especially interested in the work environment, differentiating public work from private work and the treatment that both give to equality and non-discrimination in their midst. In a first approximation, the rights that protect equality between men and women and fight against discrimination of all kinds are gathered, differentiating the constitutional framework from the jurisprudence of both the Constitutional Court and the European Court of Human Rights. After knowing the rights that protect us, the bulk of the work focuses on labor discrimination in Spain on the basis of sex, whose sections talk about the regulations applicable to it, the measures that private companies and the public sector must apply and Act 3/2007 is worked on, on the effective equality between men and women and the Law 39/1999, of conciliation of the labor, familiar and personal life. In the same way, the current topic of mobbing in companies and the barriers that the glass ceiling poses for women workers are covered.
