ASPECTOS FUNDAMENTALES SOBRE LA LEGÍTIMA DEL CÓNYUGE VIUDO

Abstract

[ES] En en el presente trabajo nos centraremos en como afecta la legítima al cónyuge supérstite. Para ello en primer lugar, haremos una comparativa de la evolución histórica general de la legítima en cuanto a la relación legítima o límite legal y la libertad de disposición testamentaria. Además, se analizará la legítima, desde un punto de vista genérico, en todo lo relativo a su concepto, naturaleza, modo de empleo por nuestro Código Civil y nuestra doctrina, así como los límites que legalmente se prevén para el causante a la hora de realizar la disposición testamentaria, lo que denominamos principios de intangibilidad de la legítima. Una vez estudiada la legítima en sus puntos más generales, entraríamos en el punto técnico y específico del trabajo, en cuanto a los presupuestos y características de la cuota usufructuaria o legítima vidual. Sobre todo, examinaremos minuciosamente el proceso de conmutación del usufructo como factor clave. Finalmente, compararemos la legítima del cónyuge viudo en la sucesión testamentaria con la sucesión intestada o abintestato y sus peculiaridades y particularidades.

[EN] In this present work we will focus on how the legitimate affects the surviving spouse. To do this first, we will make a comparison of the general historical evolution of the legitimate in terms of the legitimate relationship or legal limit and the freedom of testamentary disposition. In addition, it will analyze the legitimate, from a generic point of view, in everything related to its concept, nature, way of employment by our Civil Code and our doctrine, as well as the limits that are legally foreseen for the cause at the time of make the testamentary disposition, what we call principles of intangibility of the legitimate. Once the legitimate one is studied in its most general points, we would enter into the technical and specific point of the work, regarding the presuppositions and characteristics of the usufructuary or legitimate vidual portion. Above all, we will thoroughly examine the usufruct switching process as a key factor. Finally, we will compare the legitimate of the widowed spouse in the testamentary succession with the intestate or intestate succession and its peculiarities and particularities.
