EL DELITO DE INTERCEPTACIÓN Y DIVULGACIÓN DE COMUNICACIONES TELEFÓNICAS POR PARTE DE LOS FUNCIONARIOS PÚBLICOS

Abstract

[ES] A día de hoy, los funcionarios de la Administración Pública, manejan todo tipo de información sobre el ciudadano; es por ello que en el desarrollo de este estudio se trata de hablar de la interceptación de las comunicaciones por estos, así como de la responsabilidad que adquieren al desempeñar la difícil tarea de interceptar comunicaciones telefónicas. Se analizan además los motivos que originan dicha acción, bien sea por el camino de la legalidad, con la autorización oportuna, o contrariamente, causando la lesión de la propia intimidad, tipificada esta como delito. Se investigan las circunstancias determinantes para ubicar el delito en el lugar concreto, situar la competencia a quien pertenezca, las penas de las que puede ir acompañado; aportando soluciones para que la autoridad competente actúe acorde al ejercicio correcto de sus funciones y evitar así el derrumbe de los cimientos de la intimidad, el honor y el anonimato en la vida de cada cual.

[EN] Nowadays, Public workers handle all types of information about the citizen; that is why in the development of this study it is about talking about the interception of communications by these, as well as the responsibility they acquire when performing the difficult task of intercepting telephone communications. The motives that originate this action are also analyzed, either by the way of legality, with the timely authorization, or, conversely, causing the injury of one's own privacy, typified as a crime. The determining circumstances are investigated in order to locate the crime in the specific place, place the competence to whoever belongs, the penalties of which it may be accompanied; providing solutions so that the competent authority acts according to the correct exercise of its functions and thus avoid the collapse of the foundations of privacy, honor and anonymity in the life of each one.
