EL CONVENIO COLECTIVO EN LA REGULACIÓN DE LA PREVENCIÓN DE RIESGOS LABORALES EN LA PROVINCIA DE JAÉN (2016)

Abstract

[ES] El Convenio Colectivo en la prevención de riesgos laborales constituye un instrumento idóneo para el desarrollo y la mejora de los mínimos contenidos en la Ley. El objeto principal del trabajo ha consistido en analizar/ver el papel de la negociación colectiva en la regulación de esta materia en la provincia de Jaén en el año 2016. El análisis se ha llevado a cabo realizando previamente un trabajo de campo consistente en la búsqueda en el BOP JAÉN de los Convenios Colectivos vigentes en el año de referencia y en la posterior recapitulación de sus artículos preventivos, proveyéndonos de un resumen detalle. Los resultados han reflejado el incumplimiento de la labor otorgada al Convenio Colectivo, usándose como mero tablón publicitario de referencia del articulado de la propia LPRL, por tanto, sin consecuencias prácticas para la mejora de las condiciones de trabajo en materia de seguridad y salud laboral de los trabajadores/as.

[EN] Collective Agreement in the prevention of labor risks is an ideal instrument to improve and develop the minimums included in the Law. Our main realization purpose has consited of analyzing/seeing the role of collective bargaining in he regulation of this field in the province of Jaen for the year 2016. We have realized a fieldwork in the finding the respective Collective Ageements published in the Official Provincial Gazette of Jaen in forcé in the given year, and in the later recapitulation of preventive precepts, obtaining a summary detail. Our findings indicate breach of duty by the labor Collective Agreement, it is being used as Occupational Hazard prevention Act´s bulletin board, therefore, without practical consequences for the improvement of the conditions in regard to occupational health and safety.
