FUNDAMENTOS ROMANÍSTICOS DE LA CODIFICACIÓN CIVIL ESPAÑOLA

Abstract

[ES] En el presente trabajo trato de hacer un análisis detallado del desarrollo de los fundamentos romanísticos de la codificación civil española, mediante el estudio de la evolución que han experimentado las diferentes técnicas codificadoras a lo largo de la historia y las diferentes influencias que éstas han tenido a la hora de elaborar su respectiva codificación. Como estudio principal del trabajo me centro en abordar el estudio de la codificación civil española mediante la constitución de 1812 y sus influencias emanadas de otros códigos europeos, como el Código Francés, a la vez que también analizo la influencia que tuvo la constitución de 1812 en la formación de los códigos iberoamericanos. Con todo ello pretendo llegar a la conclusión de sí hoy en día la técnica codificadora sigue siendo válida para el desarrollo y protección de las realidades sociales.

[EN] In the present work I try to make a detailed analysis of the development of the Romanic foundations of the Spanish civil codification, through the study of the evolution that the different coding techniques have experienced throughout history and the different influences that these have had on the time to elaborate its respective coding. As the main study of the work I focus on addressing the study of Spanish civil codification through the constitution of 1812 and its influences emanating from other European codes, such as the French Code, while also analyzing the influence of the constitution of 1812 in the formation of Ibero-American codes. With all this I intend to reach the conclusion of yes today the coding technique is still valid for the development and protection of social realities.
