EL CONTADOR PARTIDOR DATIVO A PARTIR DE LA REFORMA DE LA LEY DE LA JURISDICCIÓN VOLUNTARIA

Abstract

[ES] La nueva Ley de la Jurisdicción Voluntaria y la reforma de la Ley Notarial, así como la reforma del Código Civil en cuanto a la figura del contador-partidor testamentario y del contador-partidor dativo dibujan un ambiguo régimen para ambas figuras que la escasa Jurisprudencia recaída no ha llegado a completar, lo que hace difícil su aplicación en la práctica judicial y notarial. Este trabajo pretende alumbrar algunas soluciones con el análisis de estas figuras tan parecidas y tan distintas entre sí.

[EN] The new Law of Voluntary Jurisdiction and the reform of the Notary Law, as

well as the reform of the Civil Code regarding the figure of the testamentary accountant- splitter and the dative counter-divider, draw an ambiguous regime for both figures that

the scant jurisprudence relapses it has not been completed, which makes its application in judicial and notary practice difficult. This work aims to illuminate some solutions with the analysis of these figures so similar and so different from each other.
