Las diligencias preliminares que afectan a los derechos fundamentales en el proceso penal, con especial atención a las medidas de interceptación e intervención telefónicas.

Abstract

[ES] A través de este trabajo he buscado analizar y explicar de la forma más clara y simple posible las diligencias de investigación que limitan los derechos fundamentales en el proceso penal, analizando cada una de ellas y centrándome en las referentes a las intervenciones telefónicas. También es analizado brevemente el pasado de las Ley de Enjuiciamiento Criminal que es la que recoge estas medidas, un pasado lleno de fallos que no cumplía los requisitos exigidos por el TEDH, fallos que fueron solucionados por la reforma operada por la Ley Orgánica 13/2015. Además es también explicado el proceso para poder realizar estas medidas, sus límites y los objetivos que persiguen las mismas.

[EN] Through this work i seek to analyze and explain in the most clearest and simplest form possible investigation inquiries that

limit the fundamental rights in the penal process, analyzing each one of them and focusing on those referring to the telephone interventions. Also it's analyzed briefly the past ofthe LECrim that it's the one that pickup the measures, a past full of failures that no fulfill the requirements demanded by the TEDH, failures that were solved by the Organic Law 13/2015. Also it' s explained the process to be able to carry out these measures, their limits and the obietives that they seek.
