El JUICIO VERBAL TRAS SU REFORMA POR LA LEY 42/2015

Abstract

[ES] La reforma de la Ley de Enjuiciamiento Civil por la Ley 42/2015 ha supuesto una relevante modificación del juicio verbal. Se ha establecido la equidad entre demandado y demandante con la creación de la figura de la contestación a la demanda escrita y la posibilidad de realizar el pleito sin la celebración de la vista. La sociedad va evolucionando y se necesitan cambios legislativos que concuerden con las necesidades de las personas. El principio de oralidad sigue presente, pero con una mejor función. En este estudio se analizarán las medidas que se han adoptado con el objetivo de aprender de los errores y mejorar este procedimiento. Para ello se necesita un trabajo colectivo donde legisladores y profesionales jurídicos busquen la agilidad y efectividad de los procedimientos.

[EN] The reform of the Law on Civil procedure by law 42/2015 has resulted in a significant modification of the verbal judgement. The equity between the defendant and the plaintiff has been established with the creation of the figure of the answer to the written demand and the possibility of carrying out the lawsuit without the celebration of the hearing. Society evolves, and legislative changes are necessary to match the needs of people. The principle of orality is still present, but with a better function. This study will analyses the measures taken to learn from errors and improve this procedure. This requires collective work where legislators and legal professionals have a look at the future.
